TERMS AND CONDITIONS

Preamble

These terms and conditions apply to Santa Cruz Cruises, a service provided by the company VAFOPOYLOS O.E. (herein company), registered under the Greek Laws, located at Poseidonos Avenue, 186, Marathon, Schinias, Postal Code 19007, Attica, Greece.

Injuries

Neither the company nor the Captain or his crew shall be liable for any loss of life, or personal injury which may be suffered whenever such events take place before the Passenger has embarked on board or while is ashore at an intermediate stop, or after disembarkation at the final destination.

The Captain, the crew, as well as the company bear no responsibility for passenger loss of life, injury or other damage resulting from non-compliance with the instructions of the Captain and the crew: a) during the cruise, b) when boarding and disembarking from boats, c) when going ashore or returning by swimming, d) when the ship is moored and passengers are swimming nearby (swimming stop).

For such events, taking place on board the boats, the company and the Captain shall be responsible only if the interested party will be able to prove that the particular event, was caused by gross negligence of the Captain or his crew.

Carry-on items

The Passenger is allowed to carry on board as luggage, only such personal effects which usually and reasonably are carried on board for voyages of this kind. Birds, dogs or any other pets or animals, cannot be carried along and will not be permitted on board. Passengers carrying dangerous, inflammable and contraband items or explosives will be reported immediately to the proper Public Authority and in any case, the Passenger who will disregard this warning shall be compelled to reimburse the company and the Captain for whatever damage, expenses or sacrifices will result there from.

Documents, manuscripts, jewelry, money or other valuables of any kind shall not be included in the luggage and if they are, no liability whatsoever is assumed by the company nor the Captain. Passengers who are carrying such valuables are to carry them at their own risk.

Owing Company’s liberties

The company and the Captain retain the liberty and without previous notice:

  • To cancel the cruise deal refunding only the money to the passenger

  • To cancel, change or alter any cruise

  • To decide which boat from the fleet will be used for the cruise

  • To change or modify the itinerary

The boat’s schedule must be strictly adhered to. In the event of the Passenger missing the boat at any of the destinations of the cruise’s itinerary, the company nor the Captain shall in no event be liable for such a mishap nor is expected to provide for alternative transportation.

Responsibility of liability

It should be clearly understood that the company does not undertake any responsibility of liability whatsoever for the company, store or operation, etc. of cruises which may include lunch or dinner ashore and will not be liable in any case for illness, injury, death, loss, robbery, their or any other mishap nor for the lack of organization or delay, etc. which might occur during the cruise.

The Passengers undertake the responsibility to indemnify the company for any damages which the owner or his representatives might sustain, arising from the cruise arrangements, made on his behalf and for the damages the cruise Captain and his crew might sustain from the passenger.

Children must always in custody of any adult appointed by their parents or by their legal guardian.

Pregnant women should inform the crew about their pregnancy, so as to enjoy relevant treatment.

Safety Regulations

The safety management procedures are certified by the Hellenic Maritime Authorities which comply fully with the requirements of the international ISM (International Shipping Management) code.

Further, following Hellenic Coast Guard regulations, personnel are trained and regularly tested in proficiency in emergency procedures in case of fire, recovery at sea, evacuation procedures, disaster at sea, etc.

Passengers must follow the security regulations and the boat’s Captain’s rules concerning order and safety on board the boat. The rules are displayed on the boats and explained by the Captain prior each cruise.

A sufficient number of life jackets, as well as a first aid kit are available on board.

The company and its representatives reserve the right to refuse passage to passengers who might pose a threat to the safety or other passengers, themselves or the boat.

The company and its representatives have the right to refuse passage to persons who are under the influence of alcohol or narcotics, who display disturbing or threatening behavior, or who do not otherwise comply with the aforementioned rules concerning age, security or other regulations.

Insurance

Passengers are covered by third party liability insurance. For baggage, as well as any other form of insurance please arrange individually.

Lost and Found

Items found on our boats are sent to the company base in Schinias, Marathon. If you notice you've lost something immediately after the disembarkation, please contact the Captain at our base.

Payment & Cancellations

  • All reservations must be guaranteed by credit card or deposit in bank account, at the time of booking.

  • Cancellations made up to 4 working days prior to the cruise date will carry no penalties.

  • Cancellations made within 2 days prior to sailing date will be charged in full.

  • Please note that all cancellation in order to be valid must be received in writing, via email.

  • Passengers must be present at the agreed embarkation area 30' before departure. Passengers who miss departure are not entitled to a refund.

  • The company refunds the price to the Passengers, without any other obligation towards the Passenger or any third-party, in case the cruise is canceled or suspended due to the fault of the boat or due to adverse weather conditions.

Agreement

The cruise agreement is subject to the Greek law. Any dispute on its execution is reserved to the exclusive jurisdiction on the courts of Greece.

These Terms and Conditions will be updated with any changes to the services offered or with any additions in general.
